SUMMARY:
It was once a common City practice to reserve a one-foot strip of land at the termination of, or along the side of a street when land was subdivided. These strips of land were intended to prevent access to neighboring properties. The reserve strips are owned in fee simple by the City until the adjacent land owners receive the appropriate planning approval to develop the property.
A one-foot reserve strip at the termination of Kitsap Street NW, created with West Meadows Estates No. 2, recorded in Volume 13, Page 13, of the Polk County Book of Subdivision Plats, was conveyed to the City of Salem with a Warranty Deed, Document No. 2004-015241.
A second one-foot reserve strip at the termination of Kitsap Street NW, created with Doaks Ferry Estates Phase I, recorded in Volume 9, Page 41, of the Polk County Book of Subdivision Plats, was conveyed to the City of Salem with a Warranty Deed, Document No. 1993-001260.
Both reserve strips are shown on Exhibit A of Resolution No. 2021-14. The property lying between the reserve strips has an approved planning decision, Subdivision Case No. SUB17-04, requiring the construction of the missing segment of Kitsap Street NW. The dedication of the reserve strips will allow public to access to the new street improvement.
FACTS AND FINDINGS:
1. Two reserve strips exist at the termination of Kitsap Street NW. Both reserve strips are owned by the City in Fee Simple and are not public right-of-way.
2. Council’s approval of Resolution No. 2021-14 will dedicate these reserve strips as public right-of-way and support the improvement of Kitsap Street NW over the lands being developed by Planning Case No. SUB 17-04.
