ISSUE:

 

Shall the City Council adopt Resolution No. 2021-13 dedicating properties received by the City of Salem along the east and west sides of 27th Avenue SE between Kuebler Boulevard SE and Boone Road SE as public right-of-way?

Adopt Resolution No. 2021-13 dedicating properties received by the City of Salem along the east and west sides of 27th Avenue SE between Kuebler Boulevard SE and Boone Road SE as public right-of-way.

SUMMARY:

 

It is City practice to acquire property or additional right-of-way by Warranty Deed in fee simple ownership. All or a portion of the acquired property is then dedicated as public right-of-way with a resolution adopted by City Council.

 

The City received properties through the recording of three Warranty Deeds, Reel 4462, Pages 136, 137, and 138, at Marion County.  The street improvements are a requirement of the development on Kuebler and 27th Ave. approved by City Council November 9, 2020, with the adoption of Order No. 2020-5.

 

All of the properties received and described in Resolution No. 2021-13, are ready to be dedicated as public right-of-way with the adoption of Resolution No. 2021-13 by City Council.    

 

 

FACTS AND FINDINGS:

 

1.                     The Notice of Final Land Use Decision, SPR-DAP18-15, approved by City Council November 9, 2020, with the adoption of Order No. 2020-5 for the new Costco development, required street improvements along 27th Avenue SE.

 

2.                     The City received properties on the east and west sides of 27th Avenue SE to support the proposed street improvements.

 

3.                     The properties were conveyed to the City by recording three Warranty Deeds, Reel 4462, Pages 136, 137, and 138.

 

4.                     The properties are ready to be dedicated as public right-of-way.

 

5.                     The dedicated right-of-way will allow for a roundabout to be constructed at the Costco driveway entrance on 27th Avenue SE
