FACTS AND FINDINGS:
This project is being designed in the public interest and there is a public need to acquire public right-of-way and easements from four properties to construct the required improvements, specifically to allow access to the project site. The locations and property owners of the acquisition areas are shown on Exhibit 1 to Resolution 2024-3 (Attachment 3). The City will negotiate with the property owners to acquire the required public right-of-way and easements and will pay just compensation for all acquisitions.
A single resolution declaring the need to acquire the public right-of-way and easements is all that is required at this time. A separate resolution authorizing eminent domain will be issued at a later date if negotiations between the City and any of the property owners fail.
Construction of the project is scheduled for 2025.
BACKGROUND:
This project is a CIP project funded from the 2022 Safety and Livability Bond. These improvements will include adding reinforcement to the four bridges located at Liberty Street over Mill Creek, 15th Street over Mill Creek, 17th Street over Mill Creek, and Mission Street over Pringle Creek. These four bridges are currently load posted, which limits the weight of vehicles that may safely pass over the bridges. After these improvements are complete, the load limitations will be removed.
