The 2nd Street NW Improvement Project between Gerth Avenue NW and Wallace Road NW will construct new curbs, sidewalks, lighting, stormwater facilities, and water and sewer system upgrades (Attachment 1, Project Location Map). The design has progressed to the point where it is necessary to begin the right-of-way acquisition process.

Shall City Council adopt Resolution No. 2022-14 (Attachment 2) declaring a public need to acquire and the City of Salem’s intent to negotiate for the acquisition of right-of-way and easements for the 2nd Street NW Improvement Project?

FACTS AND FINDINGS:

 

This project will create a consistent and safe street corridor along 2nd Street NW by providing local connectivity, on-street parking, and traffic calming bulb-outs at each intersection.  The project is being designed in the public interest, and there is a public need to acquire right-of-way from nine properties and easements from 35 properties to construct the required improvements. The location of the right-of-way acquisitions and easements are shown on Attachment 3.

 

The City will negotiate with property owners to acquire the required right-of-way and easements and will pay just compensation for all acquisitions. The property owners of record are identified in Attachment 4.

 

This project is fully funded by the Urban Renewal Agency and, therefore, a single resolution for the entire project declaring the need to acquire is all that is required at this time.  A separate resolution authorizing eminent domain will be issued at a later date if right-of-way negotiations between the City and any property owner fails. 

 

Construction of the project is scheduled for 2023. 

  

BACKGROUND:

 

The length of 2nd Street NW used to be owned by the Union Pacific Railroad, across Wallace Road NW and over the Union Street Railroad bridge into Salem. The Union Pacific Railroad owned the last remaining section between Rosemont Avenue NW and Gerth Avenue NW as an unpaved, gravel road until it transferred to the City of Salem in 2011. In 2013, the West Salem Urban Renewal Area funded improvements to convert it to the paved road that it is today. The urban renewal plan and the business district action plan identify additional multi-modal connectivity improvements to support current and future needs which are included with the 2nd Street NW Improvement Project.
