FACTS AND FINDINGS:
1. The land-use decision (Case No. SUB08-05MOD2) for the Mill Creek Corporate Center requires the construction of Logistics Street SE.
2. A portion of the proposed street improvement is over land owned by the City of Salem described in that Warranty Deed Reel 3366, Page 41, Marion County Deed Records.
3. The portion of City Property to be dedicated is described in Exhibit A and depicted on Exhibit B of Resolution No. 2022-8.
4. City Council’s approval to dedicate the portion of City property as public right-of-way, allows the developer to construct Logistics Street SE as required by the Case No. SUB08-05MOD2.
BACKGROUND:
The City owns a parcel of land in the Mill Creek Corporate Center that is used for stormwater detention and treatment purposes. The stormwater detention and treatment areas are significantly north of Turner Road SE but the parcel of land containing them extends southerly to Turner Road SE for access purposes. Logistics Street SE will cross over the City owned property at its intersection with Turner Road SE. Access to the stormwater detention and treat areas will not be disrupted by the dedication of this portion of property as public right-of-way.
