This is a petitioner-initiated, voter-exempt annexation of Ash Grove Subdivision and Adjacent Lands, a territory containing 3.30 acres outside the existing right-of-way of Hollywood Drive NE and 2,436 square feet within the existing right-of-way of Hollywood Drive NE - 97305 (Marion County Assessor Map and Tax Lot Number 072W18AC / 9400, 9500, 9600, 9700, 9800, 9900, 10000, 10100, 10200, 10300, 10400, 10500, 10600, 10700), for the purpose of obtaining City services. The annexation would include a concurrent application of City zoning of RS (Single Family Residential).  A vicinity map is included as Attachment 1.

Shall the City Council advance Ordinance Bill No. 1-22 approving annexation, applying City zoning, and approving withdrawal from the East Salem Sewer and Drainage District and Marion County Fire District #1 for a territory of approximately 3.3 acres located at Ash Grove Subdivision and Adjacent Lands to second reading for enactment?

FACTS AND FINDINGS:

 

On March 12, 2019, Thomas Kay, Jr., for the Thomas Kay Co., the petitioner, filed an application for annexation for certain real property identified as Marion County Assessor Map and Tax Lot Number 072W18AC02002) (the Territory), as more particularly described in “Exhibit A,” which is attached hereto and incorporated herein by reference. On June 12, 2019, Mr. Kay paid the filing fee. On June 13, 2019, Mr. Kay submitted a signed annexation application, valid triple-majority annexation petition, and recorded annexation agreement for the Territory.

 

On October 19, 2021, the Ash Grove Subdivision plat was recorded within the Territory. The Territory now consists of 14 platted lots (Marion County Assessor Map and Tax Lot Number 072W18AC / 9400, 9500, 9600, 9700, 9800, 9900, 10000, 10100, 10200, 10300, 10400, 10500, 10600, 10700) and two street rights-of-way.

 

The facts and findings supporting the annexation, zoning designation, and withdrawal from the districts can be found in Ordinance No. 1-22 (Attachment 2).    

 

BACKGROUND:

 

Council held a public hearing on the petition on December 13, 2021. Council closed the public hearing, conducted deliberations, and adopted Order No. 2021-6 ANX. Staff mailed notice of the adoption of the order on December 15, 2021. No appeal has been filed.
