Shall Council adopt Resolution No. 2021-4 dedicating a portion of the land acquired by the City of Salem at the northwest corner of 12th Street SE and Fairview Avenue SE as public right-of-way?

Adopt Resolution No. 2021-4 dedicating a portion of the land acquired by the City of Salem at the northwest corner of 12th Street SE and Fairview Avenue SE as public right-of-way.

SUMMARY:

 

During the 12th Street SE Southbound Widening project, the City acquired the property located at the northwest corner of 12th Street SE and Fairview Avenue SE in its entirety.  The property was obtained by warranty deed in fee simple ownership.  Because a portion of the property has become part of a public street, it is necessary to dedicate that portion as public right-of-way with a resolution adopted by City Council. 

 

 

The “AREA TO BE DEDICATED” as described in Exhibit A and shown on Exhibit B of Resolution No. 2021-4 is the portion of the City property that the City Council shall dedicate as public right-of-way.  The remaining portion of the property outside of the dedication area will be sold at a future date.

 

 

FACTS AND FINDINGS:

 

1.                     The property acquisition was required as part of the 12th Street SE Southbound Widening project.

2.                     The property is currently owned by the City of Salem in fee simple ownership.

3.                     Approval of Resolution No. 2021-4 by City Council will dedicate a portion of the property as public right-of-way.
