Ratify the City Manager’s execution of all U.S. Department of Justice, FY20 Coronavirus Emergency Supplement Funding Grant (CESF) documents to accept the $247,044 award.

SUMMARY:
The U.S. Department of Justice is providing funding for law enforcement’s preparation, planning and response to the FY20 Coronavirus pandemic through this grant.
The City Manager has executed the grant award documents (Attachment 1) as allowed under Council Resolution 2020-18 declaring a state of emergency relating to the Covid-19 pandemic, in order to allow the City to access these funds so that they are readily available in these challenging times.
FACTS AND FINDINGS:
1. The City received notice of the U.S. Department of Justice’s (DOJ) intent to award the FY20 CESF grant on April 23, 2020. The City had until June 7, 2020, to accept the grant award, however early acceptance allowed the city access to these funds rapidly to address unique financial challenges created by the COVID-19 outbreak.
2. The City’s award is $247,044.
3. There is no local match required for this grant.
4. The funds will be used for:
• overtime to maintain patrol and dispatch coverage during the pandemic
• overtime to backfill for officers and dispatchers should they become sick from Covid-19
• personal protective gear in the form of Tyvek suits, replacement P100 masks and cartridges, protective eyewear, disinfectant wipes, nitrile gloves and hand sanitizer
• lodging and meals for officers should they become sick and need to be quarantined separate from their families
• decontamination of patrol vehicles, the police stations and the 9-1-1 center, and
• remote work site costs.
5. The City will be required to provide quarterly financial status reports, quarterly progress reports and a final report to the USDOJ.
6. The City will be required to comply with the awarded grant’s terms and conditions and other legal requirements, including but not limited to, the Office of Management and Budget (OMB), Department of Justice regulations, and such other federal regulations included in the award. These requirements will include complying with applicable federal civil rights laws, OMB circulars, and Federal Funding Accountability and Transparency Act (FFARA) requirements.
7. The City Manager may execute amendments to the agreement if the following requirements are met: The amendments do not substantially expand the City’s obligations; The amendments do not broaden the scope of the agreement to other subjects; and, The amendments do not increase the City’s financial obligations. The amendments may extend the term or renew the agreement so long as any other changes to the agreement do not substantially expand the City’s obligations.
8. The City Manager’s execution of the documents to accept the FY20 CESF grant award was in the best interests of the City and will benefit the public and the City.
9. Council’s ratification of the City Manager’s execution of the documents to accept the FY20 CESF grant award is in the best interests of the City.
BACKGROUND:
The U.S. Department of Justice established the CESF program to assist eligible states, local units of government and tribes in preventing, preparing for and responding to the coronavirus. A total of nearly $850 million has been allocated to the program as part of the Federal stimulus legislation. USDOJ is moving quickly to make awards, with the goal of having funds available for drawdown within days of the award. The solicitation was released on March 30, 2020 and the City submitted its application on April 14, 2020.
Funds must be utilized by law enforcement to prevent, prepare for, and respond to the coronavirus.
