Authorize the City Manager to execute the attached amendment to the Motor Carrier Safety Assistance Program IGA with ODOT.

SUMMARY:
The Salem Police Department is committed to traffic safety, traffic enforcement and to projects enhancing community-wide traffic safety. The Motor Carrier Safety Assistance Program allows the Salem Police Traffic Team to perform Commercial Motor Vehicle (CMV) inspections. The inspections improve motor vehicle safety and compliance on City of Salem roadways.
Execution of Amendment Number 01 to the IGA with ODOT (Attachment 2) will allow for documentation of Commercial Vehicle, Driver and Cargo Inspections to be submitted electronically and require the Salem Police Department to take appropriate measures to protect Personal Protected Information. In all other respects the terms of the original IGA (Attachment 1) remain unchanged.
FACTS AND FINDINGS:
Salem is a hub for commercial vehicle freight traffic due to its proximity to Interstate 5 and State Highways 22 and 99. Local commerce produces a large volume of vehicles that are regulated by Federal Motor Carrier Safety Regulations. The Salem Police Department maintains between four and six certified commercial truck inspectors.
ODOT authorizes members of the Salem Police Department to address commercial vehicle safety on Salem area roadways through ODOT’s Motor Carrier Safety Assistance Program. The IGA is what ODOT uses to grant trained Salem Police personnel the authority to inspect and enforce ODOT safety regulations as they pertain to commercial motor vehicles. Without this IGA it is likely approximately 240 to 300 vehicles that fall under commercial motor vehicle guidelines would not get inspected and likely be operating on the roadways with severe safety violations. ODOT crash data indicates that crashes routinely involve a commercial vehicle.
Salem Police Department safety inspections reveal three to five violations per vehicle. Nearly half of the vehicles inspected are placed out of service with serious safety violations.
The City Manager may execute amendments to the IGA if the following requirements are met: 1) The amendments do not substantially expand the City’s obligations; 2) The amendments do not broaden the scope of the agreement to subjects other than mobile crisis response team services; 3) The amendments do not increase the City’s financial obligations; and, 4)The amendments may extend the term or renew the IGA so long as any other changes to the IGA do not substantially expand the City’s obligations.
BACKGROUND:
This will be the City’s seventeenth year participating in the Motor Carrier Assistance Program or similar grant programs. This IGA has allowed for an excellent partnership with ODOT that helps both agencies work toward making the roadways safer for traveling and working motorists.
