Shall the City Council authorize a sewer service connection to a new single-family residence on a parcel that is outside of, but contiguous to, the current city limits, conditioned on the property owner filing a complete application for annexation, an annexation agreement, and paying all usual and customary fees and service charges?

SUMMARY:

 

The owners of property located at 3880 Croisan Creek Road S (Attachment 1) have requested a sewer connection to serve an existing single-family residence (Attachment 2). The property is eligible for City sewer service under the provisions of Council Policy.

 

FACTS AND FINDINGS:

 

1.                     Council Policy specifies that a property outside City limits is eligible for sewer service if the property is developed, is contiguous to city limits, and a sewer main is available at the property line to serve the existing uses. This proposed connection to the sewer system prior to annexation conforms to the Council policy because the property is currently developed, contiguous to City limits, and staff have determined a sewer main is available at the property line to serve the property.

 

2.                     Salem Revised Code 73.030 regulates the provision of City sewer services beyond the corporate limits of the City of Salem. This section of the Code requires specific Council approval prior to granting a service connection to a City sewer line, along with a properly executed petition and consent to annex, which must include an agreement to abide by all applicable City requirements, submitted by the property owner.

 

3.                     A sewer main is adjacent to the subject property and is adequate to serve the proposed use.

 

4.                     The subject property is contiguous to City limits. Pursuant to Council Policy the applicant is required to file an application for annexation prior to receiving sewer service.

 

5.                     Staff recommends approval of the request for sewer service, conditioned on the applicant filing a complete application for annexation, an annexation agreement, and paying all usual and customary fees and service charges.

 

BACKGROUND:

 

The existing single-family residence located at 3880 Croisan Creek Road S was built in 1962 and connected to a private onsite septic system. The parcel is located within Marion County and contiguous to City limits. The owners of the property have reported that their existing septic system is failing and have requested a sewer service connection to the existing 8-inch public sewer main located within an unimproved portion of right-of-way east of the subject property. The existing septic system will be abandoned upon approval to connect to city sewer.
