Authorize the City Manager to execute the attached intergovernmental agreement with Marion County for the Mid-Willamette Valley Cable Regulatory Commission.

SUMMARY:
The attached Intergovernmental Agreement (IGA) with Marion County replaces the existing IGA, forming the Mid-Willamette Valley Cable Regulatory Commission (CRC). The IGA was last updated in July 1998. The overall mission and intent of the IGA remain the same while reflecting current members and operational procedures.
FACTS AND FINDINGS:
The IGA was approved by the Marion County Board of Commissioners on July 3, 2019.
Changes and updates to the IGA:
1. Remove the City of Keizer from the list of participating jurisdictions. The City of Keizer is no longer a participating member of the CRC;
2. Grammatical and operational changes to reflect that there are only two participating members of the CRC, the City of Salem and Marion County.
3. Change to Marion County providing staff and legal support to the CRC rather than the current language stating that the CRC would contract these services with other governments or agencies. (Section 3.3)
4. Remove Section 4.2 and renumber 4.2.1 through 4.2.3 as 4.1.5 through 4.1.7, making actions concerning cable company sanctions, operating regulations, and system changes proposed by a cable company reserved by the City and County and not delegated to the CRC.
5. Remove Section 4.2.4. The CRC does not interpret, waive provisions of, or grant variances to the cable franchise agreements.
6. Allowance of a substitute commissioner to act on behalf of an appointed commissioner. (Section 5.2)
7. Recognition that Public, Educational, and Government (PEG) fees collected from a franchised cable provider are remitted to the CRC by participating jurisdictions. (Section 7.4)
BACKGROUND:
City of Salem and Marion County formed the CRC to act on behalf of both jurisdictions to oversee and regulate cable communications systems within the combined cable service area. The CRC’s mission is to “promote a maximum possible public, educational and government access.” Two appointed City councilors and one appointed County commissioner form the CRC’s governing body.
