ISSUE:

 

Shall the City Council adopt an order to modify the Planning Commission’s decision for Class 3 Design Review, Class 3 Site Plan Review, Class 2 Driveway Approach Permit and Tree Regulation Variance Case No. DR-SPR-DAP-TRV18-07?

 

*The hearing for this matter is closed, and no further testimony will be accepted. This item is solely for the City Council to consider adoption of the written order as the final decision.

Staff recommends that the City Council adopt the order modifying the decision to approve Class 3 Design Review, Class 3 Site Plan Review, Class 2 Driveway Approach Permit and Tree Regulation Variance Case No. 18-07, with additional conditions of approval, as contained in Attachment 1.

SUMMARY AND BACKGROUND:

 

On December 18, 2018, the Planning Commission held a public hearing on the consolidated application, and voted to approve the application subject to recommended conditions of approval. On January 14, 2019, at a regularly scheduled meeting, the City Council voted to initiate review of the Planning Commission’s decision.   

 

 

FACTS AND FINDINGS:

 

On February 25, 2019 the City Council conducted a hearing to receive evidence and testimony regarding the proposal. The public hearing was closed on February 25, 2019, but the written record was left open until 5:00 PM on March 11, 2019. The City Council conducted deliberations on March 11, 2019 and voted to modify the decision of the Planning Commission approving the consolidated application for Class 3 Design Review, Class 3 Site Plan Review, Class 2 Driveway Approach Permit, and Tree Regulation Variance Case No. DR-SPR-DAP-TRV18-07. The attached order provides the facts and findings related to the City Council’s Decision.
