ISSUE:

 

Shall the City Council authorize the City Manager to execute the attached Intergovernmental Agreement (IGA) with the Oregon Department of Transportation (ODOT) to provide up to $8,000 in reimbursement funds to the City through the Motor Carrier Safety Action Plan during Fiscal Year 2018-19?

SUMMARY AND BACKGROUND:

 

Upon approval, staff will execute the attached IGA with ODOT (Attachment 1) to provide up to $8,000 in reimbursement funds to the City through the Motor Carrier Safety Action Plan during Fiscal Year 2018-19.

 

The Salem area is a hub for commercial vehicle freight traffic due to its proximity to Interstate 5 and State Highways 22 and 99. Additionally, local commerce produces a large volume of vehicles that are regulated by Federal Motor Carrier Safety Regulations. The Salem Police Department maintains between four and six certified commercial truck inspectors.

 

Inspections of commercial vehicles predominately take place on city streets to address equipment conditions, safe loading practices, and driver qualifications.  Average inspection times range from a 10 minute roadside interaction with the driver to address a driving infraction to a 30 minute off-roadway complete safety inspection. ODOT is offering to reimburse Salem Police Department for its efforts to address commercial vehicle safety on Salem area roadways through ODOT’s Motor Carrier Safety Action Plan.

 

FACTS AND FINDINGS:

 

1.                      The Salem Police Department is committed to traffic safety and traffic enforcement and to projects which enhance community-wide traffic safety.

 

2.  The most recent crash data provided by ODOT showed that 1 in 5 crashes involve a commercial vehicle.

 

3.  Salem Police Department safety inspections reveal 3-5 violations per vehicle. Nearly half of the vehicles inspected are placed out of service with serious safety violations until repairs are made.

 

4.                     Entering into the IGA with ODOT will enable Salem Police Department to maximize resources and expand the number of inspections performed.

 

5.                     The City will be reimbursed at a rate of $113.75 per Qualifying Safety Stop, up to $8,000, with no matching funds required to be paid by the City.

 

6.                     The City is required to comply with all federal, state, and local laws, regulations, executive orders, and ordinances applicable to the City’s work under the IGA, including Civil Rights requirements; non-discrimination requirements; and Americans with Disabilities Act requirements.

 

7.                     The IGA allows for amendments by mutual consent of the parties to reflect changes in service delivery, term modification, and/or funding. The City Manager may execute amendments to the IGA if the following requirements are met:

                     i.                     The amendments do not substantially expand the City’s obligations;

                     ii.                     The amendments do not broaden the scope of the agreement to subjects other than commercial motor vehicle safety stops and inspection services;

                     iii.                     The amendments do not increase the City’s financial obligations; and,

                     iv.                     The amendments may extend the term or renew the IGA so long as any other changes to the IGA do not substantially expand the City’s obligations.
