ISSUE:
Shall the City Council authorize the City Manager to execute an Intergovernmental Agreement (IGA) with the State of Oregon, Department of Transportation (State) for use of two Megabits per second of Microwave Radio Bandwidth to establish a microwave link between the City of Salem’s Willamette Valley Communications Center (WVCC) and the 9-1-1 backup facility?

SUMMARY AND BACKGROUND:
The WVCC answers 9-1-1 and Non-Emergency calls for citizens in Marion, Polk and Lincoln Counties as well as dispatching police, fire, and medical personnel in the same region. In the event the primary communications center became unusable, the City will need to transfer operations to a backup facility located in Stayton, Oregon. In order to keep the backup center current with information, data, and radio connectivity, a microwave link is necessary between the WVCC and the backup center with a capacity of two Megabits per second (2Mbs). A microwave path exists today that runs from WVCC to Eagle Crest (in West Salem hills) to Wipper Hill (in Linn County) to the Stayton 9-1-1 Backup Center. The link between Eagle Crest and Wipper Hill belongs to the State of Oregon. To complete a microwave link, the City needs to enter into a lease agreement with the State to use the Eagle Crest to Wipper Hill segment (Attachment 1). The agreement includes, but is not limited to, provisions regarding duration, compensation and payment terms, service protocols, insurance and liability, default and remedies, and termination of the agreement.
FACTS AND FINDINGS:
1. The State has agreed to charge an annual fee of $3,816.00 to the City for use of 2Mbs of the State microwave system between the Eagle Crest Communications Site and the Wipper Communications Site. The fee will increase by 3% per year.
2. The agreement runs until June 30, 2028, unless terminated earlier, and may be extended for up to two additional five year terms.
3. The State microwave system is designed specifically for use by Public Safety agencies so maximum up time is expected. The agreement contains comprehensive provisions for maintenance of the system and service restoration.
4. The Agreement allows for modification by mutual consent of the parties. The City Manager may execute amendments to the Agreement if the following requirements are met:
a. The amendments do not substantially expand the City’s obligations;
b. The amendments do not broaden the scope of the Agreement to other subject matters.
c. The amendments do not increase the City’s financial obligations; and,
d. The amendments may extend the term or renew the Agreement so long as any other changes to the Agreement do not substantially expand the City’s obligations.
