SUMMARY AND BACKGROUND:

 

On February 12, 2018, the City Council authorized the City Manager to sign the ASA Mutual Aid Agreement under the terms of the City’s ASA franchise agreement with Marion County, as required by local rules and regulations. The County’s ASA plan requires each ambulance service provider to sign a mutual aid agreement with the other providers in Marion and adjoining counties. After approval by Council, Marion County informed the City that the County was voiding the ASA Mutual Aid Agreement as it did not specify that it was retroactive to January 1, 2018.  The County is seeking to have the Mutual Aid Agreement be effective retroactive to January 1, 2018 through December 31, 2023, to match the current ASA franchise agreement, as required by County rules and regulations. The attached Mutual Aid Agreement (Attachment 1) is the same as the agreement approved by Council on February 12, 2018, except that it specifies the effective dates.  

 

FACTS AND FINDINGS:

 

The City recently renewed its ASA franchise agreement with the County to provide ambulance service within the City of Salem and surrounding areas for the next five years. Currently, the City provides these services through a public/private partnership contract with Falck Northwest Corporation, in conjunction with Salem Fire Department Resources.

 

The Mutual Aid Agreement (Attachment 1) is required of ambulance service providers in Marion County under the County’s ASA plan. Entering into the Mutual Aid Agreement is necessary for the City to be in compliance with the terms of the ASA franchise agreement. The purpose of the Mutual Aid Agreement is to provide effective and efficient operation of emergency medical services in the event of disaster or numerous requests for assistance in one parties’ ASA. The parties agree, during the term of their ASA franchises, to furnish personnel and equipment upon request to other parties who cannot provide effective and efficient emergency ambulance services dues to extraordinary circumstances.

 

The Mutual Aid Agreement allows for modification by mutual consent of the parties. The City Manager may execute amendments to the Agreement if the following requirements are met:

a.                     The amendments do not substantially expand the City’s obligations;

b.                     The amendments do not broaden the scope of the Agreement to other subject matters.

c.                     The amendments do not increase the City’s financial obligations; and,

d.                     The amendments may extend the term or renew the Agreement so long as any other changes to the Agreement do not substantially expand the City’s obligations.
