Shall City Council authorize the City Manager to execute the attached amendment to the Intergovernmental Agreement with Salem-Keizer School District (SKSD) 24J, extending the closing date to September 28, 2018 for transferring multiple properties between the City and SKSD?

SUMMARY AND BACKGROUND:

 

On October 28, 2016, and as amended on June 12, 2017, and December 11, 2017, the City and SKSD entered into an Intergovernmental Agreement (Agreement) (Attachment 1) to transfer multiple properties to accurately reflect the use and ownership of each parcel.

 

FACTS AND FINDINGS:

 

Survey work required by the Agreement is taking longer than anticipated, and it is necessary to amend the Agreement to allow time to complete the necessary field work and documents. Staff recommends changing the closing date from March 31, 2018, to September 28, 2018, as described in the proposed amendment (Attachment 2). Two properties, West Salem High School and Pringle Elementary School, will require additional time to complete the boundary work. The deeds for those properties will be completed and recorded as soon as possible, but no later than December 31, 2018. Any transaction costs for those two properties accrued after March 31, 2018, shall be borne by the City of Salem. All other terms of the Agreement remain unchanged.
