Shall the City Council authorize the City Manager to execute the attached Intergovernmental Agreement (IGA) with the Salem-Keizer School District (District) and any amendments to the IGA in order to provide police services within the District’s schools during the 2017-2018 school year?

SUMMARY AND BACKGROUND:

 

The Salem-Keizer School District serves approximately 42,000 students, with the majority of its facilities located within the City of Salem. The Salem-Keizer School District has contracted with the City of Salem for police services for over nineteen years.  Nine police officers, including one Corporal and one Sergeant, have been assigned to the Youth Services Unit (YSU) for this purpose. Police officers assigned to YSU handle reports of criminal activity and status offenses in and around the schools. At the conclusion of the 2016-17 school year the IGA between the District and the Salem Police Department expired. The parties have been engaged in on-going negotiations, and have recently reached an agreement for the provision of police services during the 2017-18 school year (Attachment A). The parties had been operating under an contract extension which expired on December 31, 2017.  

FACTS AND FINDINGS:

 

1.                     The District has agreed to pay $553,881.00 to the City for police services within the District’s schools during the 2017-18 school year. This payment covers approximately 50% of the costs for the police officers assigned to the YSU during the school year.  This money also helps to offset the cost of other police responses to the District’s schools.

2.                     Total compensation may be adjusted by the District in situations where the City fails to assign an officer to a school for (5) five consecutive student contact days. There are currently sufficient Police Department resources that this situation is not anticipated to occur.

3.                     The assignment of officers within the schools will be a collaborative decision between the District and the City.

4.                     Execution of the IGA is in the best interest of the City of Salem and the public.

5.                     The Agreement allows for modification by mutual consent of the parties. The City Manager may execute amendments to the Agreement if the following requirements are met:

a.                     The amendments do not substantially expand the City’s obligations;

b.                     The amendments do not broaden the scope of the Agreement to other subject matters.

c.                     The amendments do not increase the City’s financial obligations; and,

d.                     The amendments may extend the term or renew the Agreement so long as any other changes to the Agreement do not substantially expand the City’s obligations.  ]
