SUMMARY AND BACKGROUND:
The Oregon Office of State Fire Marshal (OSFM) is required to adopt a plan for the coordinated response to oil or hazardous material spills or releases that occur during rail transport. As part of this response plan, BNSF Railway, Union Pacific Railroad and OSFM agreed to strategically place firefighting foam trailers throughout the State of Oregon to provide a quicker and more effective response time to rail and other incidents that require large amounts of firefighting foam application.
OSFM and Union Pacific have entered into an agreement that authorizes local agency first responders to use and store the firefighting foam trailer. The City of Salem Fire Department has been selected to receive one of the Union Pacific owned firefighting foam trailers.
FACTS AND FINDINGS:
This IGA outlines requirements and responsibilities of the OSFM and the City for the use of the Union Pacific owned firefighting foam trailer for a period of two years.
The City of Salem will be responsible for the following:
1. Storage of the firefighting foam trailer with constant power, free of charge.
2. Complete monthly inspections.
3. Allow OSFM and Union Pacific railway company access to the firefighting foam trailer on a continuous basis (24/7).
4. Use of the firefighting foam trailer as deemed necessary for training and emergency response.
5. Notification to OSFM if the firefighting foam trailer is to be used.
6. Replace used foam and any broken equipment within thirty calendar days. It will be the responsibility of OSFM to notify Union Pacific of needed repairs and foam replacement costs attributable to an incident response.
