SUMMARY AND BACKGROUND:

 

In May 1995, the City of Salem (City) and the Suburban East Salem Water District (District) entered into an Intergovernmental Agreement (IGA) to ensure continued water service from the City’s municipal distribution system to the District for the District’s use and resale (Attachment 1). This IGA is scheduled to expire on December 31, 2017.

 

The parties wish to continue water service from the City’s municipal distribution system to the District, and would like to negotiate a new IGA to bring it up to date with the current practices and expectations of the parties. Staff anticipates these negotiations will take several months.

 

 

FACTS AND FINDINGS:

 

The existing IGA between the City of Salem and the Suburban East Salem Water District will expire on December 31, 2017. The City and the District are currently in negotiations to develop a new long-term agreement that will reflect current practices and expectations. The proposed amendment to the existing IGA (Attachment 2) will extend the term of the agreement for one year, to December 31, 2018. The extension will allow additional time to draft an updated IGA. If the amendment is approved, all provisions of the existing Agreement will remain in effect.
