ISSUE:

 

Shall the City Council authorize the City Manager to execute the attached Intergovernmental Agreement (IGA) with Marion County, and any amendments to the IGA, in order to provide Mobile Crisis Response Team services during Fiscal Years 2017-2018 and 2018-2019?

Authorize the City Manager to execute the attached IGA (Attachment A) with Marion County, and any amendments to the IGA, in order to provide Mobile Crisis Response Team services during Fiscal Year 2017-2018 and 2018-2019.

SUMMARY AND BACKGROUND:

 

The City has contracted with Marion County for approximately three years to bring mobile crisis response services to the City of Salem and Marion County. The Mobile Crisis Response Teams primarily respond to calls that have a mental health component, and the teams provide assistance to other agencies throughout the county with these types of calls. These teams provide after-hours support and follow-up to individuals who have had recent interactions with law enforcement. The teams can also make referrals to community partners. The Marion County Mobile Crisis Response Team (MCRT) consists of one sworn law enforcement officer and one qualified mental health professional.

 

The City and County have been engaged in on-going negotiations since June for the continued provision of MCRT services. The City has continued to provide MCRT services during this time. The attached IGA is for MCRT services during the 2017-2018 and 2018-2019 Fiscal Years, and is retroactive to July 1, 2017, when the previous IGA expired.

  

 

 

FACTS AND FINDINGS:

 

1. The IGA requires the Salem Police Department to assign a minimum of one sworn police officer to the Marion County Mobile Crisis Response Team.

 

2.                      The IGA requires Marion County to pay the City of Salem up to $145,280.00 for Fiscal Year 2017-2018, for salary, benefits, equipment, training and operational costs.

 

3.                     The IGA requires Marion County to pay the City of Salem up to $150,900.00 for Fiscal Year 2018-2019, for salary, benefits, equipment, training and operational costs.

 

4.                     The City is required to comply with applicable: Federal laws, regulations, executive orders, and guidelines; HIPAA requirements; EEOP, Civil Rights and rehabilitation, and anti-discrimination requirements; Clean air, clean water, energy efficiency and EPA regulations; Resource conservation and recovery requirements; Federal audit requirements; and Drug-Free Workplace and Pro-Children Act requirements. The City is also required to certify compliance with Truth in Lobbying requirements.

 

5. The City in partnership with the County will meet OHA requirements regarding: Records Maintenance, Access and Confidentiality, Alternative Formats of Written Materials and Reporting Requirements.  

 

6.                     The IGA allows for amendments by mutual consent of the parties to reflect changes in service delivery, term modification, and/or funding. The City Manager may execute amendments to the IGA if the following requirements are met:

                     i.                     The amendments do not substantially expand the City’s obligations;

                     ii.                     The amendments do not broaden the scope of the agreement to subjects other than mobile crisis response team services;

                     iii.                     The amendments do not increase the City’s financial obligations; and,

                     iv.                     The amendments may extend the term or renew the IGA so long as any other changes to the IGA do not substantially expand the City’s obligations.

 

7.                     Execution of the attached IGA will benefit the public and the City of Salem.
