Shall City Council authorize the City Manager to execute the attached Amendment 1 to the Intergovernmental Agreement (IGA) between Marion County and the City of Salem extending Salem Police Department usage of the Marion County District Attorney’s Case Management System (DACMS) for an additional five years?

Authorize the City Manager to execute the attached Amendment 1 to the IGA between Marion County and the City of Salem extending Salem Police Department usage of the DACMS for an additional five years.

SUMMARY AND BACKGROUND:
DACMS is a records management system maintained by the Marion County District Attorney’s Office (MCDA). The City and Marion County entered into an IGA on October 11, 2012, granting the Salem Police Department limited access to DACMS for law enforcement purposes. The original IGA was for a period of five years and expires on October 11, 2017.
The parties wish to extend the IGA for and additional five years, with all other terms of the original IGA remaining unchanged.
FACTS AND FINDINGS:
1. Access to DACMS assists the Salem Police Department in providing law enforcement related data and services.
2. The City does not incur any costs under the IGA. The City’s main obligations are to only allow Authorized Users to access DACMS, to train Police personnel on use of the system, and to only use the system for proper purposes.
3. Extension of the IGA for an additional five year period by executing the attached Amendment 1 will benefit the public and is in the best interest of the City by creating greater efficiencies and data sharing.
4. The IGA allows for amendments. The City Manager may execute additional amendments to the IGA if the following requirements are met:
a. The amendments do not substantially expand the City’s obligations;
b. The amendments do not broaden the scope of the agreement to subjects other than access and use of the DACMS;
c. The amendments do not increase the City’s financial obligations; and,
d. The amendments may extend the term or renew the IGA so long as any other changes to the IGA do not substantially expand the City’s obligations.
