SUMMARY AND BACKGROUND:

 

On March 27, 2017, Council approved the purchase of the building located at 1700-1770 Water Street NE (Premises) (Attachment 2) for use by Capital Community Television (CCTV) for storage of its vehicles and equipment. The purchase was completed on March 31, 2017. The Premises is jointly owned by the City and Marion County (County), 77% and 23% respectively. Similar to the City and County’s ownership of the CCTV facility located at 575 Trade Street SE, it is necessary to formalize CCTV’s use and occupancy of the Premises via a license agreement. The $550,000 purchase of the Premises was funded with Public, Educational, and Government (PEG) access fees collected by the Mid-Willamette Valley Cable Regulatory Commission (CRC).

 

 

 

FACTS AND FINDINGS:

 

The key terms of the agreement are;

 

                     Term: The License shall remain in effect for so long as the management agreement between CCTV and the CRC remain in effect,

                     Fee: None,

                     Operational expenses: CCTV is responsible,

                     Maintenance and Repair: CCTV is responsible,

                     Alterations/Improvements:  CCTV is responsible for all costs, work is to be done by City, and

                     Insurance: The property is covered under the City’s overall self-insurance program, and CCTV is required to maintain liability insurance and insurance for its personal property.
