SUMMARY AND BACKGROUND:

 

Jane Aiken, Municipal Court Judge, is recommending the reappointment of David W. Hittle as a Municipal Judge Pro Tempore for a term of two years.

 

Chapter V, Section 24 (7), of the 1996 Salem Charter authorizes the City Council, upon recommendation of the municipal judge, to appoint municipal judges pro tempore.

 

Salem Revised Code (SRC) 4.015(b) sets forth the qualifications of municipal judges pro tempore.  SRC 4.015(b) states that no person shall be eligible for appointment as municipal judge pro tempore unless the person is at least 21 years of age, a citizen of the United States, and an active member in good standing of the Oregon State Bar. 

 

SRC 4.020(b) provides for the term of office for a municipal judge pro tempore.  It states that a municipal judge pro tempore shall serve a term not to exceed two years and that the length of the term shall be recommended by the municipal judge and set by the City Council at the time of appointment.

 

 

FACTS AND FINDINGS:

 

David W. Hittle has served in the Salem Municipal Court as Judge Pro Tempore since March of 2011 and continues in that capacity to the present day.  The current term for David W. Hittle as Judge Pro Tempore will expire on June 16, 2017.  David W. Hittle is experienced and meets the qualifications to be appointed as a municipal judge pro tempore as set forth in the Salem Revised Code.  He is being recommended for appointment for another term of two years.
