Authorize the City Manager to execute a donation agreement with Mountain West Investment Corporation (the Donor)  for construction modifications, repairs, and enhancements to the interactive spray fountain in Riverfront Park.

SUMMARY AND BACKGROUND:

 

Mr. Lawrence Tokarski, through his corporation, Mountain West Investment Corporation, is requesting the City accept a donation for enhancements to the spray fountain. The enhancements will improve the functionality and public’s enjoyment of the fountain. The value of the enhancements is approximately $110,000.

 

The Donor will acquire and construct modifications, repairs, and enhancements

to the spray fountain, at Donor's sole cost and expense, and donate the completed modifications to the City.

 

Through a $150,000 donation from Mr. Tokarski in 2009, an interactive spray fountain at Riverfront Park was constructed.  The donation allowed the City of Salem an opportunity to realize a goal outlined in the 1999 Comprehensive Parks and Recreation System Master Plan. 

 

FACTS AND FINDINGS:

 

 Sometimes called a splash pad, the interactive spray fountain uses a system of jets to spray water up from a hard surface. 

 

Retrofitting the splash pad includes replacing existing heads with new play features; installation of new connection points; installation of new concrete at new feature locations; installation of a water hammer arrestor; and reconfiguration of the existing water system to optimize performance.

 

The majority of the donation will fund the play features. New play feature enhancements include four Fun FormsTM Aqua Spouts; Gravity ShootersTM;  Water RingsTM; and Fill N’ SpillTM

 

The repair and enhancement work will be completed by the Donor. Once the City inspects and accepts installation of the repairs and enhancements to the spray fountain, the City will be responsible for the on-going maintenance and repair.

 

The donation agreement does not bind or obligate the Donor to make the donation, but sets the terms for the donation and for the City’s acceptance of the donation. Terms include specifications for the work, insurance, warranty, and repair or replacement of damaged property
