SUMMARY AND BACKGROUND:
The owners of the property at 4932 Swegle Road NE (see Attachment 1) have requested water service to serve an existing single family residence (Attachment 2). The parcel is contiguous to City limits, is located in East Salem Service District for wastewater services, and is currently served by a private domestic well. The owners have reported the well produces water with excessive sediments, making it unusable for drinking or other household uses.
FACTS AND FINDINGS:
1. Council Policy X-4 specifies that a property outside City limits is eligible for water service if the property is developed, is contiguous to city limits, and a water main is available at the property line to serve the existing uses. This proposed connection to the water system prior to annexation conforms to the Council policy with the exception of the water main location. However, staff have determined the property can be served by an existing water main in Swegle Road NE, approximately 140 feet west of the subject property.
2. Salem Revised Code 72.220 regulates the provision of City water services beyond the corporate limits of the City of Salem. This section of the Code requires specific Council approval prior to granting a service connection to a City water line, along with a properly executed petition and consent to annex, which shall include an agreement to abide by all applicable City requirements, submitted by the property owner.
3. A water main is located in close proximity to the subject property and is adequate to serve the proposed use.
4. The subject property is contiguous to City limits. Pursuant to Council Policy X-4, the applicant is required to file an application for annexation prior to receiving water service.
5. Staff recommends approval of the request for water service, conditioned on the applicant filing a complete application for annexation, an annexation agreement, and paying all usual and customary fees and service charges.
