ISSUE:

 

Shall the City Council authorize the City Manager to resolve a lawsuit brought by the Estate of Chase Hammer and its personal representatives in an amount not to exceed $100,000.     

 

 

RECOMMENDATION:

Authorize the City Manager to resolve the matter of the Estate of Chase Hammer v. City of Salem in an amount not to exceed $100,000.  Payment will be made from the City’s self-insurance claim fund.

SUMMARY AND BACKGROUND:

 

The matter of the Estate of Chase Hammer v. City of Salem is currently pending in the United States District Court: case No. 6:13-cv-01824-AA. Through settlement negotiations, the City has agreed to resolve all claims associated with the lawsuit in consideration of a payment of $100,000.    

 

 

FACTS AND FINDINGS:

 

The terms of the settlement constitute a complete release and full satisfaction of all claims related to this action.  The City’s HR Director, City Attorney, and Risk Manager recommend the City Council authorize the City Manager to settle this matter and issue payment as outlined above.
