SUMMARY AND BACKGROUND:
The Oregon Department of Transportation (ODOT) is expanding the Interstate 5 interchange at Kuebler Boulevard SE. The expanded interchange adds a loop on-ramp in the northwest quadrant of the interchange to better accommodate westbound Kuebler Boulevard SE traffic headed to southbound I-5, and includes a ramp expansion where the new and existing southbound on-ramps merge onto I-5 traffic (see Attachment 1). The construction of the ramp improvements is Phase I of the interchange project.
Phase II of the project consists of constructing a sound wall along the southbound on-ramp adjacent to the residential housing along Landon Street SE. ODOT has conducted a noise study and determined that the conditions warrant construction of a sound wall-at no cost to property owners-if a majority of the affected property owners voted in favor of constructing the wall. ODOT has conducted a vote by mail process and a large majority of property owners voted in favor of the wall construction.
ODOT and their construction contractor require access for construction, and ongoing maintenance, of the sound wall via the Boone Road SE right-of-way, from 27th Avenue SE east to the I-5 right-of-way. This section of the Boone Road SE right-of-way was closed to traffic when it was bifurcated by the original construction of I-5. The right-of-way contains City water lines and franchise utilities.
FACTS AND FINDINGS:
The following is a summary of the key terms of the proposed IGA:
• The City will allow ODOT the use of City streets (Boone Road SE east of 27th Avenue SE) for construction and maintenance access purposes.
• ODOT will install a permanent gate on the east side of 27th Avenue SE. ODOT construction and maintenance staff and City of Salem maintenance staff will have keyed locks to the gate for use as needed.
• ODOT is responsible for all work and costs associated with building the sound wall.
• ODOT shall perform and be responsible for all maintenance of the sound wall.
• The agreement shall remain in effect for the useful life of the sound wall defined to be twenty years.
