Shall the City Council adopt (1) Resolution No.2016-39, modifying the terms of the commissioners to coincide with their term as a city councilor for the members who also serve on the City Council, and modifying the term of the resident member to end on December 31 on the fourth year of appointment, and; (2) accept the resignation of Commissioner Karavaev, and declaring the resident member position on the Commission vacant?

SUMMARY AND BACKGROUND:

 

Appointment to the Housing Authority Commission is set by City Council resolution. Currently commissioners serve a four year term that expires on the fourth anniversary of their date of appointment.  Because state law requires housing authority commissioners to be appointed through resolution of the city council, the terms of the commissioners have been out of sync with the terms of the city councilors.  If adopted, Resolution No. 2016-39, will provide that the terms of the city councilors serving on the Housing Authority Commission will expire on December 31 four years thereafter.

 

The term of the resident commissioner position will continue to be a four year term, beginning on the date of appointment, and will expire on December 31 of the fourth year of appointment. If vacancies occur in any commissioner position, the appointed successor will fill out the remainder of the term (The resident commissioner is limited by state law to a four year term).

 

Due to a staff oversight, the terms of Commissioners Brad Nanke and Jim Lewis expired on April 30, 2016, and were not timely reappointed.  ORS 456.100(4) provides that a commissioner shall hold office until a successor has been appointed and qualified. Resolution No. 2016-39 will reappoint Commissioners Nanke and Lewis, effective May 1, 2016, and will extend the terms of all Council-Commissioners to December 31 of the year their term as Councilor expires, and modify the term of the Resident-Commissioner to expire on December 31, 2016.

 

Lastly, Commissioner Karavaev has submitted her resignation.  It is recommended that Council accept her resignation and declare the resident commissioner position vacant.

 

FACTS AND FINDINGS:

 

ORS 456.095(5) provides that a governing body shall adopt by resolution the appointment or reappointment of a housing authority commissioner.  City Council Resolution No. 69-199 declares that the Salem City Council shall be Commission of the Housing Authority.

 

Currently, the Housing Authority Commission terms are for four years and end on April 30 of the year after their term as Councilor expires.  The City Council terms end on December 31st, which causes some confusion and additional work to track the separate term dates for the two separate governing bodies.  This resolution would change the current April 30 term dates to December 31 of the year that their term as Councilor expires to eliminate the different term ending dates.

 

Vera Karavaev, the Resident-Commissioner, has submitted her resignation. Resolution 2016-39 accepts her resignation and declares the position vacant.  Housing Authority staff have been seeking qualified and interested applicants to fill this position.
