SUMMARY AND BACKGROUND:

 

On May 16, 2017, Salem voters approved a General Obligation Bond Measure to build a new Police Facility at the former O’Brien Honda site, located on the northeast corner of Commercial Street NE and Division Street NE.

 

An alley currently bisects the property; occupying 8,009 square feet as depicted in Exhibit A of Resolution No. 2018-2 (See Attached). The design of the proposed Police Facility requires that the alley be vacated prior to development. A conceptual site diagram for the Police Facility is provided in Attachment 3.  

 

 

FACTS AND FINDINGS:

 

1.                     Per Oregon Revised Statute 271.130, the city governing body may initiate a right-of-way vacation proceedings.

2.                     Per Salem Revised Code (SRC) 266.065(b)(1)(B), a vacation initiated by the City is a Class 2 Vacation. A Class 2 Vacation is initiated by resolution of the City Council.

3.                     Resolution No. 2018-2 initiates the vacation of the alley at the site of the new police facility.

4.                     The area proposed for vacation contains approximately 8,009 square feet of land.

5.                     Upon approval of Resolution 2018-2, a public hearing date will be set and notice of the hearing will be provided as required by SRC 255.065(b)(5).

6.                     The criteria for approving vacation of right-of-way are contained in SRC 255.065(b)(6), and will be reviewed by Council at the public hearing.
