SUMMARY AND BACKGROUND:

 

Administrative Rule 109-800-002, Utility Billing, was adopted on June 22, 2007. The administrative rule establishes the City’s policies and procedures for opening a utility account with the City, and methodologies for billings, payments, and collections on utility accounts.

 

The proposed amendments to Administrative Rule 109-800-002 clarify the procedures for requesting a hearing on a disputed utility bill. Specifically, the amendments establish a 15-day time limit from the billing date to submit a request for a hearing on a disputed bill. Further, the amendments set a time frame of seven days to pay the utility bill in full if the hearings officer finds the charges are due and owing.

 

 

FACTS AND FINDINGS:

 

The Notice of Administrative Rule Making (Attachment 1) will be posted January 09 through January 23, 2018. Interested parties will have 15 days to provide comment to staff. Subject to review by Council, the rule will become effective on January 24, 2018.  This notice is give pursuant to SRC 20J 040(a)(3)

 

Adoption of Administrative Rules does not require Council approval. Council may elect to review the proposed Administrative Rule; however, the scope of Council’s review is limited to determining: (1) whether the rule is within the scope of the provision of the Code authorizing adoption; and (2) whether the rule is duplicative of, or conflicts with, another rule or other federal, state or local law or regulation, or is outside of the range of staff’s rulemaking authority. The Legal Department has reviewed the proposed rules for consistency with the code pursuant to SRC 20J.080.
