Shall the City Council authorize the amendments to the Intergovernmental Agreement for The Creation of the Downtown Advisory Board to reflect; 1) administrative changes to the board composition representation and definitions; 2) remove item 1.6 that requires consultation of the Downtown Advisory Board before making final decisions on any parking petitions filed; 3) reorder Recital (i) to a new Recital (k); 4) replace Recital (i) with a reference to Resolution No. 2013-68 adoption of Initiative Petition No. 001-2013-IP and 5) other administrative updates?

SUMMARY AND BACKGROUND:
On December 6, 2004, the City Council approved the IGA for The Creation of the Downtown Advisory Board. The last amendment was approved on August 31, 2015, to replace an SRC reference relating to board appointments.
The Amendments will reflect a recent Council decision to 1) remove the non-voting, ex-officio members of the Downtown Advisory Board; and 2) provide that the six Council appointments to the Downtown Advisory Board be business or property owners within the “Riverfront Downtown Urban Renewal Area” rather than the “Downtown Parking District.” Additionally it is recommended to remove item 1.6 that requires consultation from the Downtown Advisory Board before making any final decisions on parking petitions filed and to update recitals and SRC references.
The proposed Resolution (Attachment 1) identifies the amendments. Amendments that remove text are reflected as strikethroughs while additions and replacement text is bold and underlined.
FACTS AND FINDINGS:
On July 25, 2016, City Council and the Urban Renewal Agency Board approved the recommendations of the Boards and Commissions Appointment Committee to; 1) amend the definitions of board representations for the Downtown Advisory Board; and 2) remove the two non-voting, ex-officio positions. It is also being recommended to remove item 1.6 that requires consultation from the Downtown Advisory Board before making any final decisions on parking petitions filed, and administrative updates to the IGA’s Recitals and SRC references. The removal of the two ex-officio positions will be effective on December 31, 2016 to allow those members to complete their terms.
