A worker’s compensation claim is pending.  Through settlement negotiations, the City has agreed to enter into a Claim Disposition Agreement (CDA).

ISSUE:

 

Shall City Council authorize the City Manager to resolve a workers’ compensation claim for Maurice Stadeli (Deceased) in the amount not to exceed $550,000.00.  

 

 

RECOMMENDATION:

Authorize the City Manager to resolve the matter of Maurice Stadeli’s (Deceased) workers’ compensation claim in an amount of $550,000.00.  Payment will be made from the City’s self-insurance claim fund.

FACTS AND FINDINGS:

 

Mr. Stadeli is a former Salem Firefighter who passed away in February 2019 due to cancer.  His widow, Tina Stadeli, has accepted the conditions in a Claim Disposition Agreement (CDA).  The terms of the CDA constitute a full and final settlement of this workers’ compensation claim.

The City’s portion of the settlement is approximately $85,000. The state will be responsible for approximately $134,000 and the City’s excess carrier will be responsible for approximately $331,000.
