The 16th Street SE Culvert Replacement Project will replace a failing culvert at the 16th Street SE crossing of East Fork Pringle Creek. To meet regulatory requirements and future transportation needs, the new culvert will be larger. Temporary and permanent easements are necessary to construct and maintain the new culvert.

Shall City Council adopt Resolution No. 2026-7 (Attachment 1) declaring a public need to acquire and the City’s intent to negotiate for the acquisition of easements for the 16th St SE Culvert Replacement Project?

FACTS AND FINDINGS:

 

                     The 16th Street SE Culvert Replacement Project location is shown on the Project Location Map (Attachment 2).

                     The project is being designed in the public interest, and there is a public need to acquire easements from three property owners to construct and maintain the new culvert and associated stream improvements.

                     The locations and property owners of the easement acquisitions are shown on Exhibit 1 to Resolution 2026-7 (Attachment 3).

                     The City will negotiate with the property owners to acquire the required easements and will pay just compensation for the acquisitions.

                     A single resolution for the entire project declaring the need to acquire is all that is currently required.

                     A separate resolution authorizing eminent domain will be requested later if negotiations between the City and the property owners fail.    

 

BACKGROUND:

 

The existing 13-foot-wide and 40-foot-long culvert at the 16th St SE crossing with East Fork Pringle Creek is estimated to be over 70 years old and is failing. The 16th St SE Culvert Replacement Project will replace this failing culvert with a larger concrete box culvert that meets state and federal regulatory requirements as well as providing for future roadway widening as identified in the City of Salem Transportation System Plan. Construction is planned for 2027.
