FACTS AND FINDINGS:
City staff and the Districts have negotiated new IGAs (Attachments #1 & #2). The new IGAs will be effective until June 30, 2041, and replace the previous twenty-year IGAs that are set to expire October 30, 2021.
The obligations of the City under the proposed IGAs remain consistent with the previous agreements. The City will continue to provide the following services:
• Allow each District to connect to City owned wastewater infrastructure at a point and in a manner designated by the City;
• Receive applications and issue permits for connections approved by the City;
• Maintain, repair, and replace, certain wastewater infrastructure within the Districts as needed;
• Enforce continued compliance with City Code; and,
• Collect Wastewater Service Charges and Systems Development Charges.
The obligations of each District will continue to include the following:
• Adopt and enforce regulations for wastewater collection and disposal that are consistent with the provisions of Salem Revised Code;
• Compel property owners to connect to available wastewater infrastructure;
• Construct to City standards, new wastewater infrastructure added to the existing wastewater system within the District;
• Replace undersized water infrastructure that is needed to address District system expansion; and,
• Require District customers to pay Wastewater Service Charges and Systems Development Charges.
The City Manager may execute amendments to the IGAs if the following requirements are met: 1) The amendments do not substantially expand the City’s obligations; 2) The amendments do not broaden the scope of the agreements to other subjects; 3) The amendments do not increase the City’s financial obligations; and, 4) The amendments may extend the term or renew the IGA so long as any other changes to the IGA do not substantially expand the City’s obligations.
BACKGROUND:
The City has had long-standing agreements to provide wastewater collection and treatment services to the unincorporated areas of Marion County within the Salem-Keizer urban growth boundary. In August 2003, the City entered into its most recent Intergovernmental Agreements IGA with the East Salem Service District and the Labish Village Sewage & Drainage District to ensure continued wastewater collection and disposal services. These agreements were scheduled expire on June 30, 2021. Extension of the agreements until October 30, 2021, were approved by City Council on June 28, 2021.
