ISSUE:

 

Shall City Council adopt Resolution No. 2023-39 dedicating a remnant piece of City owned property as public right-of-way to be known as Simpson Street SE?

Adopt Resolution No. 2023-39 dedicating a remnant piece of City owned property as public right-of-way to be known as Simpson Street SE.

FACTS AND FINDINGS:

 

1.                      A remnant piece of property previously owned by Marion County was conveyed to the City of Salem by Quitclaim Deed, Reel 609, Page 392, Marion County Deed Records and is referenced by Marion County as Tax Lot 073W26DC08800.                     

 

2.                     The City intends to dedicate the City property as public right-of-way to be known as Simpson Street SE. Dedicating the property will preserve it for potential future use if the intersection of 22nd Street SE and Simpson Street SE is improved.

3.                      The City property to be dedicated is depicted on Exhibit A of Resolution No. 2023-39.    

 

BACKGROUND:

 

Public rights-of-way are generally strips of land given to the public for specific uses such as roadways, bridges structures, and public utilities.  They are available for use by the public at large and are administered by jurisdictions such as a City, County, or State.  Most streets in Salem are public rights-of-way and are controlled by the City.  Some streets such as Wallace Road NW and portions of Mission Street SE are also public rights-of-way; however, they are mostly controlled by the Oregon Department of Transportation.  There are also private streets in the City such as Creekside Drive SE which are not public rights-of-way.
