FACTS AND FINDINGS:
On April 21, 2025, the Airport Manager received a lease extension and amendment request from the GSA for space leased to the National Weather Service at the Salem-Willamette Valley Airport. After Legal review it was noted that the federal government inserted several clauses into the lease that did not exist in the original lease. Although not all applicable to this lease, these amendments are required in all federal leases and cannot be removed, thereby requiring City Council approval.
BACKGROUND:
The National Weather Service leases 236 sq ft and currently pays $8,040 in annual rent. The lease was executed in 2015 and expires in 2025 subject to its two five-year option periods. The lease extension provides for an increase in rent paid to the airport to $8,281/year for the next five-year period (2025-2030) and $8,530/year for the second five-year period (2031-2035).
Sections 52.204-2, 52.204-9, 52.204-21, 52,204-23, 52.204-25, 52.204-27, 52.204-30 and 552.204-9 were requested to be removed as they are not applicable to a real property lease but would apply to a contract for goods or services. There was no explanation from the GSA as to how they apply to this lease, except that they are not authorized to remove those provisions.
