As part of the 2022 Safety and Livability Bond program, the City of Salem is acquiring property necessary for the future construction of sidewalk improvements along the south side of Harritt Drive NW, which is a part of the larger Marine Drive NW project. The affected parcel is 2060 Wallace Road NW (Tax Lot 073W16A03001), owned by Jonathan Clark (Attachment No. 1).

FACTS AND FINDINGS:

 

The 2022 Safety and Livability Bond includes a project to construct Marine Drive NW in West Salem, extending from Harritt Drive NW to 5th Avenue NW.

 

Construction of approximately 600 feet of Marine Drive NW immediately south of Harritt Drive NW was recently completed.  This early segment was constructed in coordination with the adjacent Applegate Terrace Apartments development and proceeded ahead of the larger project timeline. Coordination of this early work brought staff into contact with the Seller, who were able to advise of the scope of future sidewalk and other improvements adjacent to Harritt Drive on Seller’s property. After Seller indicated openness to completing a transaction for the required property, Staff advised Council of the opportunity in Executive Session on June 9, 2025.

 

Staff and Seller have come to terms on a Purchase and Sale Agreement (Attachment No. 2) for acquisition of the Real Property.  The key terms of the agreement are:

 

Price:        $165,000

Site Size:   17,299 square feet or 0.40 acres

 

The Seller’s property occupies a “flag lot” with a narrow access strip connecting the larger property to Wallace Road NW. The negotiated acquisition cost includes compensation for the land needed for the improvements, which occupy enough of the narrow access strip to necessitate its entire purchase. The Seller will continue to have access to Wallace Road NW via the newly constructed portion of Marine Drive NW and Harritt Drive NW.  Decommissioning of an existing well, drilling of a replacement well east of Marine Drive NW, and removal of an existing business sign are also included in the acquisition costs.    

 

BACKGROUND:

 

Design work for the larger Marine Drive NW project is ongoing. Right-of-way needs for the remainder of the project will be determined in the next few months at which time staff will return to Council with a Resolution to acquire necessary property rights along the entire project corridor.
