SUMMARY AND BACKGROUND:
Passage of Ordinance Bill No. 16-18 (Attachment 1) will result in new provisions to Salem Revised Code Chapter 15 related to public art. The new provisions will ensure the City is able to contribute funding to the Public Art Trust Fund for eligible public projects and meet requirements of restricted funds, such as general obligation bond proceeds.
FACTS AND FINDINGS:
Funds generated by the half percent for public art on eligible projects are deposited into the Public Art Trust Fund. In general, 70 percent of the funds are used for acquisition, 20 percent for managing Salem’s public art, and ten percent for the maintenance and conservation of works within the public art collection. Revenues from general obligation bond or other bond proceeds, or urban renewal tax increment carry restrictions and may limit public art projects to a specific location, geographic area, or purpose.
The proposed changes make provisions for the use of restricted funds for public art. Restricted funds will be included within the budget for an improvement project and not be deposited in the Public Art Trust Fund. Upon a preliminary determination of the amount of eligible funds, including restricted funds, to be allocated for public art for an improvement project, the Public Art Commission shall make a determination of the type and location for public art for the improvement project. Prior to commencement of any work to prepare the public art, the Public Art Commission shall approve the final design. Upon substantial completion of the public art, the Public Art Commission shall review the work for acceptance into the City’s public art collection consistent with the Public Art Commission’s adopted guidelines.
