Shall the City Council authorize the City Manager to execute the attached amendment to the Purchase and Sale Agreement with the State of Oregon?

Authorize the City Manager to execute the attached amendment to the Purchase and Sale Agreement with the State of Oregon.

SUMMARY:

 

On June 12, 2017, Council authorized the City Manager to execute a Purchase and Sale Agreement (Agreement) (Attachment 1) with the State of Oregon (Seller) for acquisition of property (Property) located at the NW corner of the former Oregon State Hospital site at the intersection of 23rd Street NE and D Street NE. Seller desires to amend the Agreement (Amendment) (Attachment 2) to include language for a lease (Lease) on the site to allow existing Oregon Department of Environmental Quality (DEQ) air quality monitoring equipment to remain in place after the transfer.

 

 

FACTS AND FINDINGS:

 

Seller will assign the Lease to the City upon transfer of the Property. Section 1 of the Agreement will be modified as shown on Attachment 2.   

 

BACKGROUND:

 

Funding for this acquisition will come from Parks System Development Charges.
