The Marine Drive NW Project includes constructing a new collector street from Harritt Drive NW to 5th Avenue NW with a new street connection to Wallace Road NW and a multi-use path connection to Wallace Marine Park. (Attachment 1) The project is currently in design, and it is necessary to begin the property acquisition process.

ISSUE:
Shall City Council adopt Resolution No. 2026-16 (Attachment 2) declaring a public need to acquire and the City of Salem’s intent to negotiate for the acquisition of right-of-way and easements for the Marine Drive NW Project.

FACTS AND FINDINGS:
This project is being designed to serve the public’s interest and there is a public need to acquire right-of-way and easements from twenty-eight (28) properties to construct the required improvements. The location and property owners of the easement acquisitions are shown on Exhibits 1 and 2 to Resolution 2026-16 (Attachments 3 & 4). The City will negotiate with property owners to acquire the required right-of-way and easements and will pay just compensation for all acquisitions.
A single resolution for the entire project declaring the need to acquire is all that is required at this time. A separate resolution authorizing eminent domain will be issued at a later date if negotiations between the City and any property owner fails.
Construction of the project is scheduled for 2028-2031.
BACKGROUND:
This capital improvement project is funded from the 2022 Safety and Livability Bond and utility rates. The improvements consist of one travel lane in each direction, curbs, sidewalks, stormwater drainage, waterline, street lighting, and a multi-use path. There have been prior opportunity property acquisitions along the roadway alignment and short segments of the roadway have been previously constructed.
