ISSUE:
Shall City Council authorize a water service connection to an existing commercial and industrial use on a parcel that is outside of, but contiguous to, the current City limits, conditioned on the property owner filing a complete application for annexation, executing an annexation agreement, paying all usual and customary fees and service charges, and complying with applicable codes and standards?

FACTS AND FINDINGS:
A vicinity map is included as Attachment 1, along with a letter from the property owner requesting City water service provided as Attachment 2.
The subject property is currently served by a private domestic well that has been identified as a health hazard due to the presence of E.coli bacteria. A "boil order" was issued on November 8 for tenants at the property by the Oregon Health Authority.
The proposed connection to the water system aligns with Council Policy X-4, A-B, which allows water service to properties contiguous to City limits under certain conditions. A public water main is available in Silverton Road NE, adjacent to the property, and is adequate to serve the existing use, which includes 12 commercial and industrial units.
Under Salem Revised Code 72.220, Council approval is required to extend City water service beyond City limits. The property owner must submit a petition and consent to annexation, which includes an agreement to comply with all applicable City requirements.
Because the property is contiguous to City limits, the owner is required to file an annexation application and record an annexation agreement prior to receiving water service, as specified in Council Policy X-4, A-B.
BACKGROUND:
Council Policy X-4, A-B, specifies that a property outside City limits is eligible for water service if the property is developed, is contiguous to city limits, and a water main is available at the property line to serve the existing uses.
