SUMMARY AND BACKGROUND:
As a part of the Madrona Avenue SE/25th Street SE Intersection Widening project, the City of Salem realigned and reconstructed portions of Aviation Loop SE as a newly configured access to the airport terminal at McNary Field. The vacation of the right-of-way for the old Aviation Loop SE will allow the City to dedicate a new right-of-way description matching the recently constructed roadway alignment.
The vacation process will return ownership of unused right-of-way to City ownership. Once the vacation process is complete, an area specifically describing the new roadway will be dedicated as right-of-way. Portions of the vacated area and the proposed dedication area overlap. The existing right-of-way is being vacated in its entirety to simplify legal descriptions and to limit the likelihood of errors in describing the new alignment. The new roadway alignment follows the Airport’s Master Plan and provides a loop road for users of the terminal building. Public and franchise utilities that may be located within the vacated area directly serve the airport property and are not expected to require the retention of easements, and will be included in the newly dedicated right-of-way as needed.
FACTS AND FINDINGS:
1. Per Oregon Revised Statute 271.130, the city governing body may initiate a right-of-way vacation proceedings.
2. Per Salem Revised Code (SRC) 266.065(b)(1)(B), a vacation initiated by the City is a Class 2 Vacation. A Class 2 Vacation is initiated by resolution of the City Council
3. Resolution No. 2018-69 initiates the vacation of Aviation Loop SE.
4. Upon approval of Resolution 2018-69, a public hearing date will be set and notice of the hearing will be provided as required by SRC 255.065(b)(5).
5. The criteria for approving vacation of right-of-way are contained in SRC 255.065(b)(6), and will be reviewed by Council at the public hearing.
