SUMMARY AND BACKGROUND:
On September 29, 2017, the Planning Administrator adopted an order approving Phased Tentative Subdivision Plan and Urban Growth Preliminary Declaration Case No. SUB-UGA17-08 subject to 17 conditions of approval (Attachment 3). At the October 9, 2017 regular meeting, the City Council voted to initiate review of the Planning Administrator’s decision.
FACTS AND FINDINGS:
Procedural Findings
1. On June 30, 2017, the applicant submitted an application for a Phased Subdivision Tentative Plan for a proposal to divide an approximately 4.96 acre property at 3906 Corredale Drive S (Attachment 1) into 20 lots over the course of two phases (Attachment 2). After the applicant submitted an application for Urban Growth Area Preliminary Declaration, the consolidated application was deemed complete for processing on July 28, 2017.
2. Notice of Filing and a Request for Comments on the proposal was sent to the Southwest Association of Neighbors (SWAN) and surrounding property owners pursuant to Salem Revised Code requirements on August 2, 2017.
3. On September 29, 2017, the Planning Administrator issued a decision approving the proposed Phased Tentative Subdivision Plan and Urban Growth Preliminary Declaration subject to conditions of approval.
4. At the October 9, 2017 regular meeting, the City Council voted to initiate the review of the Planning Administrator’s decision. A public hearing before the City Council is scheduled for November 13, 2017.
5. Notice of the public hearing was sent to SWAN, surrounding property owners and everyone that submitted comments on the proposal, pursuant to Salem Revised Code requirements, on October 24, 2017. Notice of the public hearing was posted on the subject property on October 31, 2017.
6. The 120-day state mandated decision deadline for this case is November 25, 2017.
Substantive Findings
7. The tentative plan proposes to divide 4.96 acres into 20 lots for residential development, with development taking place in two phases. Phase 1 would include 11 lots ranging in size from 5,502 square feet to 10,825 square feet, located on the southern portion of the subject property. Phase 2 would subdivide the remaining 2.42 acres into 9 lots ranging in size from 5,836 square feet to 10,805 square feet for residential development.
8. Because the subject property is outside of the Urban Service Area, an Urban Growth Preliminary Declaration must be obtained prior to, or in conjunction with, the application for Phased Tentative Subdivision Plan. The consolidated application includes an application for an Urban Growth Preliminary Declaration to determine the public facilities required under the Urban Growth Management Program to develop the proposed phased subdivision.
9. The applicable criteria and considerations that must be satisfied for the consolidated application are found in SRC Chapter 200 (Urban Growth Management) and SRC Chapter 205 (Land Division and Reconfiguration). Findings establishing conformance with the applicable approval criteria are included in the Planning Administrator’s September 29, 2017 decision order and can be found on pages 13-30 (Attachment 3).
10. SWAN did not submit comments in response to the August 2, 2017 Notice of Filing and Request for Comments. Comments were received from surrounding property owners generally concerning traffic congestion and safety, infrastructure, stormwater, vegetation, property values and wireless communication services. The issues raised are summarized and addressed in the September 29, 2017 decision order, which can be found on pages 8-13, of Attachment 3.
ALTERNATIVES
11. The City Council may affirm, amend, or reverse the decision of the Planning Administrator for Subdivision / Urban Growth Preliminary Declaration Case No. SUB-UGA17-08.
I. AFFIRM the decision for SUB/UGA 17-08.
II. MODIFY the decision for SUB/UGA 17-08.
III. DENY the application.
RECOMMENDATION
12. Based on the facts and findings within the September 29, 2017 decision, staff recommends that the City Council find that the proposed Phased Tentative Subdivision Plan and Urban Growth Preliminary Declaration satisfies the applicable approval criteria of SRC Chapter 200 and 205 and AFFIRM the decision of the Planning Administrator.
