The Oregon Department of Administrative Services (State), Oregon State Fair Council (Fairgrounds), and City staff have come to terms on an agreement to transfer property needed along Silverton Road NE for a 2022 Safety and Livability Bond project in exchange for the construction of a pedestrian crossing on 17th Street NE near the Fairground’s Jackman-Long building.

FACTS AND FINDINGS:
The Silverton Road NE Improvements Project shown on the Project Location Map (Attachment 1) includes asphalt pavement rehabilitation, bringing existing curb ramps into compliance with current standards, modifying existing traffic signals, adding enhanced pedestrian crossings, and rehabilitating a section of existing sanitary sewer main.
Construction of the project is scheduled to begin during the summer of 2025.
Key facts of the Agreement (Attachments 2 and 3) are below:
The City will acquire the following from the State:
1. Right of way on Silverton Road NE to accommodate the construction of road and sidewalk improvements as a part of the 2025 Pavement Rehabilitation project.
2. Temporary construction easement for construction of a temporary sewer bypass for the Silverton Road Sanitary Sewer Rehabilitation project.
3. The difference in cost between the right-of-way needed for City improvements and the construction of the pedestrian crossing on 17th Street adjacent to the Jackman-Long building.
The State will receive the following from the City:
1. Construction of a new pedestrian crossing on 17th Street NE adjacent to the Jackman-Long building with ADA-compliant ramps, streetlights, edge-lit signs, pedestrian refuge island, and pavement markings.
Consideration: The current estimated value of the right of way and easements is $270,000 and the current estimated cost to construct the pedestrian crossing is $375,000. The City shall provide the State and Fairgrounds with updated estimates of these values as design progresses. After construction of the crossing improvements, the City shall provide an accounting of the actual cost of the crossing and the Fairgrounds shall pay the City the difference in value.
BACKGROUND:
This Silverton Road NE Improvements Project includes multiple components from various funding sources.
Approved as a part the 2022 Safety and Livability Bond, one component of this overall project will rehabilitate existing pavement, bring existing curb ramps into compliance with the American with Disabilities Act, and modify traffic signals along Silverton Road NE, from 17th Street NE to Williams Avenue NE, and from Beacon Street NE to Fisher Road NE. The Bond will also fund a pedestrian crossing on Silverton Road NE near the Oregon State Fairgrounds to Marion County Health Services and sidewalk replacements at various locations along the corridor.
The North Gateway Urban Renewal Area will fund intersection improvements at 17th Street NE and Silverton Road NE.
A Safe Routes to School state grant will fund an enhanced pedestrian crossing near Sedona Avenue NE that will better serve pedestrians accessing Washington Elementary School.
Utility rates will fund the rehabilitation of an existing sanitary sewer main using a cured-in-place-pipe (CIPP) method along Lana Avenue NE, Silverton Road NE, and Evergreen Avenue NE.
On May 28, 2024, City Council adopted Resolution 2024-25, declaring a public need to acquire and the City of Salem’s intent to negotiate for the acquisition of right of way and easements for the Silverton Road NE Improvements Project.
