Shall the Commission adopt Resolution No. 2302 approving the Revised Admissions and Continued Occupancy Plan, effective January 1, 2024?
RECOMMENDATION:

Adopt Resolution No. 2302 approving the Revised Admissions and Continued Occupancy Plan implementing Moving to Work activities, updating criminal background screening criteria, aligning over-income and flat rent procedures with current requirements, clarifying the sunset date of the Earned Income Disallowance, and updating/correcting language to bring the Admissions and Continued Occupancy Plan in line with current requirements.

FACTS AND FINDINGS:
The revised Public Housing Admissions and Continued Occupancy Plan includes the following updates:
1) Aligning the Housing Authority’s policies and processes around households determined to be over-income to align with HUD requirements (eliminates the requirement to terminate tenancy and allows over-income families to continue to rent their unit at market rent);
2) Updating the procedure for establishing flat rents to comply with current requirements;
3) Clarifying that after December 31, 2023, the Earned Income Disallowance (EID) will no longer be required (EID sunsets by HUD statute on January 1, 2026);
4) Updating the criminal background screening criteria for Public Housing to align with screening criteria used for other Housing Authority owned and operated properties;
5) Implementing Moving to Work activities (simplified utility allowance, self-certification of assets up to $50,000, biennial income and eligibility re-examinations); and
6) Minor clarifications of other administrative policies and procedures.
BACKGROUND:
The Admissions and Continued Occupancy Plan (ACOP) is the principal document describing in detail the Housing Authority’s policies with respect to key topics such as eligibility, tenant selection, admissions preferences, waitlist procedures, rent determination, utilities, transfers, occupancy guidelines, grievance procedures, and others. The ACOP is an important document for applicants, tenants, community members, PHA staff, and HUD staff when inquiring about specific Housing Authority policies.
