Authorize the City Manager to execute the attached Intergovernmental Agreement between the City of Salem and the Office of Legislative Assembly (OLA) for OLA’s use of a portion of State Street adjacent to the south side of the Capitol for ten years in exchange for two million dollars ($2,000,000) in compensation.

FACTS AND FINDINGS:
1. The Oregon Legislative Assembly (OLA) has an interest in enhancing the safety and security of members of the Legislative Assembly, legislative staff, and visitors at the Oregon State Capitol.
2. The attached Intergovernmental Agreement (IGA) allows OLA to use a portion of the left, northernmost lane of State Street that is adjacent to the south side of the Capitol and between Cottage Street NE and Waverly Street NE for the next ten years.
3. The IGA obligates OLA to compensate the City two million dollars ($2,000,000) for the use of this segment of State Street for a period of 10 years.
4. The IGA requires the City and OLA to work cooperatively on matters related to improvements at this location, including permits, design, specifications, construction plan review, and other matters.
5. OLA will be responsible for all costs related the improvements at this location, including construction, operation, and maintenance.
6. The funds received from OLA will be deposited into the City’s General Fund.
7. The agreed value of the compensation the City will receive from OLA is based on the City’s best professional judgment of the reasonable value of the use of underlying property over a ten-year period.
BACKGROUND:
The Oregon Legislative Assembly (OLA) and the City have worked in close collaboration to develop an Intergovernmental Agreement. In this agreement, OLA is provided use of State Street adjacent to the south side of the Oregon State Capitol building for ten years. During this period, OLA will implement measures designed to enhance safety and security for members of the Legislative Assembly, legislative staff, and visitors. In compensation, the City will receive from OLA the sum of $2,000,000.
